LIABILITY WAIVER & ASSUMPTION OF RISK AGREEMENT

PLEASE READ CAREFULLY — THIS IS A LEGAL RELEASE OF LIABILITY
By entering and participating in activities within The Black Room Consumption Lounge, operated by BMD LLC d/b/a Black Market Dispensary, I acknowledge and agree to the following:
1. ELIGIBILITY & COMPLIANCE
I confirm I am 21 years of age or older and will present valid government-issued identification upon request. I understand cannabis consumption is regulated under New Mexico law and agree to comply with all applicable laws, posted rules, and staff instructions at all times.
2. ASSUMPTION OF RISK
I understand that consuming cannabis products (including flower, concentrates, edibles, and vaporized products) involves inherent risks, including but not limited to impairment, dizziness, anxiety, paranoia, nausea, increased heart rate, delayed onset effects, and potential allergic reactions. I voluntarily assume all risks, known or unknown, associated with entering the lounge and consuming cannabis.
3. PERSONAL RESPONSIBILITY
I agree to consume responsibly and within my personal limits. I will not operate a vehicle or machinery under the influence. I accept full responsibility for my actions, behavior, and decisions while on the premises.
4. HEALTH & MEDICAL DISCLOSURE
I acknowledge cannabis may interact with medications or medical conditions. I confirm I am not pregnant or breastfeeding and have no condition that would make participation unsafe. I assume full responsibility for any health-related consequences.
5. RELEASE OF LIABILITY
I hereby release, waive, and discharge BMD LLC, Black Market Dispensary, The Black Room, and their owners, members, employees, contractors, affiliates, and property owners/landlords from any and all claims, liabilities, damages, or causes of action arising out of or related to: cannabis consumption, use of lounge equipment, conditions of the premises, or the actions of other patrons. This release applies to negligence to the fullest extent permitted by law.
6. EQUIPMENT USE
I understand that rented or shared equipment (including glassware, rigs, and electronic devices such as Puffco products) carries risk. I agree to use all equipment as instructed and accept responsibility for any misuse, damage, or injury resulting from use.
7. RULES & RIGHT TO REFUSE SERVICE
I agree to follow all lounge rules and understand that staff may refuse service or remove me at any time for safety concerns, overconsumption, or non-compliance, without refund.
8. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless BMD LLC and Black Market Dispensary from any claims, damages, costs, or expenses (including attorney's fees) arising from my actions, conduct, or participation.
9. MEDIA RELEASE (OPTIONAL)
I consent to the use of my image or likeness in photo/video content for marketing purposes unless I notify staff otherwise in writing.
